Oh thank heaven - no more 7-Eleven

Congratulations, every one, on a hard fought victory. A unanimous decision by the City Council finding that the building permit was invalid as the nonconforming use had been discontinued and intentionally abandoned and that the use was expanded and intensified, therefore the non-conforming use is considered illegal. Now the city will issue a violation notice to 7-11 and presumably PDP, to which they will be required to respond.

Because we don't know at this point how soon they will be required to shut down, it is imperative that we still file our objections to the transfer of the liquor license with ABC. There have been drafts/templates sent out that you can use to do this. The main issue, as we understand it, from ABC's perspective is the fact that the city has now finally determined that the 7-11 market use is an illegal non-conforming use. Based on this determination, we understand that ABC will not transfer the license.

 

Of course, raise any other issues you feel are relevant to ABC's provisions as additional grounds, but we understand that the City's determination is the most important factor at this point.

Thanks to all for their hard work, persistence, determination and grit in the face of spurious assertions by PDP and 7-Eleven as to our integrity.

Many thanks to Attorney Camas for assisting us, and to all those who worked so tirelessly to put on presentations, contact council and planning commission members, stay on top of the press, protest in front of the store, communicate with neighborhood members, attend endless hours of public hearings, and so so much more. We couldn't have prevailed as we did without all of this and the myriad of other things that were done behind the scenes. This is everyone's victory.
